Snapshots of Laws and Regulations Relating to Hydrogen Energy (Taiwan)

On July 4, 2023, the Ministry of Economic Affairs announced that "Hydrogen Fuel Is Designated as a Form of Energy Specified in Subparagraph 6 of Article 2 of Energy Administration Act," and this took effect immediately. From this point on, the supply and use of hydrogen fuel are subject to the Energy Administration Act. However, the specific regulatory details within the framework are currently unclear and await further amendments of related regulations by the Ministry of Economic Affairs. Specifically, it is necessary to amend the existing "Criteria of Energy Supply, Energy Consumption, and Required Safety Energy Storage for Energy Suppliers and Users to Fulfill Their Respective Responsibilities Regulated by Energy Administration Act" to include corresponding standards for hydrogen fuel. Additionally, amendments should be made to regulatory content related to "energy audits," "energy data reporting," and "obligations to appoint technicians or energy managers" for the compliance by hydrogen fuel supply enterprises and users.
In addition, in order to accommodate the development of the hydrogen vehicle industry, the Ministry of Economic Affairs pre-announced on July 28, 2023 two drafts: "Hydrogen Fuel for Final Use by Hydrogen Vehicle Is Designated as an Energy Product of Which the Operation of Energy Business Shall Not Be Engaged in Sale Without Approval, as Specified in Paragraph 2 of Article 6 of Energy Administration Act" and "Regulations Governing Approval for Hydrogen Fuel Sales Operation at Hydrogen Refueling Stations." The former requires the operation of sales business involving the "supply of hydrogen fuel to hydrogen vehicles" to obtain a permit in advance, while the latter, taking reference from the "Regulations Governing LPG Station Installation and Administration," provides more comprehensive guidelines in aspects such as the permission and operation of hydrogen fuel sales business as well as the land use, facilities, safety distances, leakage alarms, registration, and other matters. The above-mentioned drafts will be announced and implemented in the near future.
