The Ministry of the Interior amended relevant rules to allow infrastructure lands to be flexibly provided for multiple purposes such as green energy(Taiwan)

The Ministry of the Interior promulgated Article 3 as amended of the Rules for Multi-purpose Use of Infrastructure Lands in Urban Plans (hereinafter, the "Rules") via the Tai-Nei-Ying-Zi-1060813594 Directive of September 20, 2017. The Rules are highlighted below:

 

  1. To carry out energy conservation and carbon reduction and encourage the use of public transportation, Article 3, Subparagraphs 2 and 4 are amended to additionally stipulate that infrastructure lands may be used for "public transport stops." Meanwhile, to take into account cityscapes and maintain the quality of green transportation services, it is additionally stipulated that the parking lots for "bicycles" shall be free from the restrictions under the Schedule.


 

  1. To enhance existing meteorological observation and seismic monitoring networks to facilitate the grasp of weather and seismic information, Article 3, Subparagraph 2 of the Rules is amended to additionally require that "meteorological observation and seismic monitoring stations" shall be free from the restrictions under the Schedule.


 

  1. To accommodate the Statute for Developing Renewal Water Resources and promote the development, supply and use of renewable water, Article 3, Subparagraph 3 of the Rules is amended to additionally stipulate that "renewable water" facilities shall be free from the restrictions under the Schedule.


 

  1. To accommodate energy policies and promote the use of renewable resources and the diversification of energy sources, Article 3, Subparagraph 7 of the Rules is amended to stipulate that usage such as the installation of solar energy and small wind power in buildings shall be free from the restrictions under the Schedule. In addition, to create a comprehensive mobile broadband environment and enhance disaster rescue communications efficiency and the overall national competitiveness, it is additionally stipulated that buildings may be used for telecommunications antennas.

  2. To cope of the current social development and the composite and diversified use of lands, the amendments also include the usage items for the land types under the Schedule in Article 3. For example, to accommodate the trend of population aging and low birth rates, additional provisions or amendments are made for the land type for social welfare facilities.  To revitalize assets, realize the resource benefits of land utilization and provide more diverse services to the citizens seeking government services, new usage items are added for lands used by government agencies.  To diversify and additionally provide locations for life-long learning and room for cultural activities and performances, the usage items for "social and educational institutions and cultural institutions" are added or amended.  To improve the efficiency of space usage, usage items for "public use" are added.
