房屋共有人未经全体共有人同意占有共有物之全部或一部后 为自己用益将之出借或出租 非属管理共有物之行为(台湾)

最高法院于民国106年2月8日作成106年台上字第100号民事判决(下称本号判决)指出,房屋共有人未经全体共有人同意占有共有物之全部或一部后为自己用益将之出借或出租非属管理共有物之行为。

本号判决事实为本件上诉人主张:双方共有系争房屋,被上诉人未经其同意,将该房屋一楼出租他人使用,二楼无偿供他人住用,每月受有相当租金33万元之不当得利,故请求被上诉人应按其共有比例返还。

本号判决指出共有物之出租或出借,属共有物之管理行为,除应符合多数决之规定,尚应有为全体共有人管理共有物之意思。倘共有人未经全体共有人同意占有共有物之全部或一部后,为自己用益将之出借或出租,既非基于管理共有物意思所为,纵其人数及应有部分合计超过上开规定,亦不得谓其为管理共有物之行为。

本号判决进而指出本件被上诉人似未经全体共有人同意,即以系争房屋已全归其用益,而将之出借或出租,则原审判决徒以被上诉人之人数及应有部分合计均过半数,即谓其出借或出租属管理行为,非无权占用,已有可议等理由,废弃原审判决发回更审。
