公平交易委员会于104年12月24日以公法字第1041561063号令修正发布「公平交易委员会对于事业发侵害著作权、商标权或专利权警告函案件之处理原则」（下称本原则）第6点并自即日生效。
本原则第6点修正是为放宽本原则之适用，除包括不公平竞争外也包括限制竞争。修正后明文为：同一产销阶段竞争关系事业侵权之情形）事业不当对外发布与其非属同一产销阶段竞争关系之事业侵害其著作权、商标权或专利权之警告函，而造成限制竞争或不公平竞争情事者，亦有本处理原则之适用。
