定共有物之分割方法应斟酌各共有人之意愿、共有物之性质与经济效用及全体共有人之利益等情形为适当公平之分割(台湾)

最高法院于民国105年10月20日作成105年度台上字第1790号民事判决(下称本号判决)指出,定共有物之分割方法应斟酌各共有人之意愿、共有物之性质与经济效用及全体共有人之利益等情形为适当公平之分割。

本号判决之事实为系争土地为双方所共有,原告起诉请求分割为A案或B案所示方法,原审认定系争土地以如B案所示方法分割,并相互以金钱补偿,惟另一方不服提起本件上诉。

本号判决指出定共有物之分割方法,固可由法院自由裁量,惟仍应斟酌各共有人之意愿、共有物之性质、经济效用及全体共有人之利益等情形,为适当公平之分割。

本号判决再指出,其中一方于原审抗辩:如依B案分配,将该某共有人分配较多之面积,而侵蚀其他共有人分配面积之虞,却未见原审叙明不予采取之理由,有判决理由不备之违法。而原审以部份十一名共有人应有部分微少,不予分配土地,惟原可受分配土地面积,除有特别情事外,原则上应按比例分配予其他共有人全体,始符公平,原审置之不论,亦有违法为由,应予废弃并发回更审。
