Article 8, Paragraph 5 of the Law Governing Food Safety and Sanitation provides: “Food businesses belonging to a category and scale designated by the central competent authority in a public announcement shall obtain the certification of sanitation and safety management systems..” Article 48, Paragraph 1, Subparagraph 2 of the same law provides: “Anyone committing any of the following and failing to correct the violation within the time limit prescribed shall be fined between NT$30,000 and NT$3,000,000. In case of severe circumstances, the enterprise may be ordered to terminate business, suspend business for a certain period of time, revoke all or part of the items listed in the company registration, business registration or factory registration, or the registration of the food businesses. If registration of the food businesses is revoked, re-application for new registration shall not be permitted within one year:… 2. Failure to file registration in violation of Paragraph 3 of Article 8, or failure to obtain certification in violation of Paragraph 5 of Article 8.”
The Ministry of Sanitation and Welfare issued the Bu-Shou-Shi-1041107736 Directive of December 25, 2015 to stipulate requirements for factory registration and for flour, starch, salt, sugar and soy sauce food manufacturers with a capital in excess of NT$30 million to be certified under sanitation and safety management systems. The requirements will go into effect on July 1, 2016.
