To accommodate the implementation of ” A worker shall have two regular days off every seven days. One day is a regular leave and the other one is a rest day.”, under Paragraph 1 of Article 36 of the Labor Standards Act as amended, the Ministry of Labor compiled and released the Frequently Asked Questions, which are updated from time to time to address questions from all walks of life. The March 24, 2017 update indicated that a rest day shall not be implemented as two half days.
This update was made to address the issue of “whether a rest day can be implemented as two half days or not”, the Ministry of Labor pointed out that a rest day is arranged basically with seven consecutive days as a cycle. With the exception of flexible work hours, there shall be one rest day in each cycle. To ensure that workers receive complete benefits for two regular days off each seven days, a rest day shall not be implemented as two half days.
